FOUNDIX Terms and Conditions

1. Acceptance of Terms

Welcome to Foundix.

By accessing or using Foundix, including its website, applications, tools, AI-powered services, and related products ("Services"), you agree to be bound by these Terms and Conditions.

If you do not agree to these Terms, you must not access or use the Services.

2. Description of Services

Foundix provides business-related tools and services, including but not limited to:

  • Business Discovery
  • AI Consultant
  • Business Planning Tools
  • AI-powered Workspaces
  • Future AI Agent Services
  • Business Productivity Tools
  • Educational and informational content
  • Certain services may be released as beta, preview, or coming-soon features.

3. Eligibility

You must be at least 18 years old or have legal capacity under applicable laws to use Foundix.

You are responsible for ensuring your use complies with all applicable laws and regulations.

4. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities performed under your account
  • Providing accurate registration information
  • Foundix reserves the right to suspend or terminate accounts that contain false information or violate these Terms.

5. AI-Generated Content Disclaimer

Foundix may provide outputs generated using artificial intelligence technologies.

You acknowledge and agree that:

  • AI-generated content may contain inaccuracies or incomplete information.
  • AI outputs are provided for informational purposes only.
  • Foundix does not guarantee the accuracy, completeness, reliability, or suitability of AI-generated content.
  • Users remain solely responsible for all business, financial, legal, operational, or strategic decisions.
  • Foundix is not responsible for any loss, damage, or liability arising from reliance on AI-generated outputs.

6. Business Discovery Disclaimer

Business Discovery is intended to provide guidance and structured exploration of business opportunities.

Results provided by Business Discovery:

  • Are not investment advice
  • Are not financial advice
  • Are not legal advice
  • Do not guarantee business success
  • Users are responsible for conducting their own due diligence before making decisions.

7. Credits, Payments and Subscriptions

Certain Foundix services may require:

  • Credit purchases
  • Subscription plans
  • One-time payments
  • All purchases are final unless otherwise required by law.
  • Unused credits have no cash value, cannot be redeemed for cash, and cannot be transferred between users unless explicitly allowed.
  • Foundix may modify pricing, credit consumption rates, or subscription plans at any time with reasonable notice.

8. Refund & Credit Policy

All credit purchases, subscription payments, one-time payments, and other paid services are non-refundable unless otherwise required by applicable law.

Once credits have been purchased, used, expired, or allocated to a service, they cannot be refunded, exchanged for cash, transferred, or converted into other forms of value.

Users are responsible for reviewing service details, pricing, and credit requirements before making a purchase.

Foundix may, at its sole discretion, provide credits, adjustments, or remedies in exceptional cases, but doing so does not create any obligation to provide refunds in the future.

9. Beta Features

Foundix may provide beta or preview features.

Beta services:

  • May contain bugs
  • May be modified or discontinued at any time
  • Are provided "as is"
  • Foundix does not guarantee availability or continuity of beta features.

10. Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Upload malicious software
  • Attempt unauthorized access
  • Interfere with system operations
  • Use the Services to generate fraudulent, deceptive, harmful, or illegal content
  • Abuse automated systems
  • Foundix reserves the right to suspend accounts involved in prohibited activities.

11. Intellectual Property

All software, branding, trademarks, designs, content, and technology associated with Foundix remain the property of Foundix or its licensors.

Users retain ownership of content they submit.

By using the Services, you grant Foundix a limited license to process and store submitted content for service delivery purposes.

12. Service Availability

Foundix strives to maintain reliable service but does not guarantee uninterrupted availability.

Services may be temporarily unavailable due to:

  • Maintenance
  • Security updates
  • Infrastructure failures
  • Third-party service disruptions

13. Limitation of Liability

To the maximum extent permitted by law:

Foundix shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Loss of profits
  • Business interruption
  • Loss of business opportunities
  • Loss of data
  • The total liability of Foundix shall not exceed the amount paid by the user to Foundix during the previous twelve (12) months.

14. Indemnification

You agree to indemnify and hold harmless Foundix, its affiliates, officers, employees, and partners from any claims, losses, damages, liabilities, or expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any law or third-party rights

15. Termination

Foundix may suspend or terminate access at any time if:

  • These Terms are violated
  • Fraudulent activity is detected
  • Security risks are identified
  • Required by law
  • Termination does not remove obligations incurred before termination.

16. Changes to Terms

Foundix may update these Terms from time to time.

Continued use of the Services after updates constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.
